Superior Court

The Superior Court of Cobb County is a court of general jurisdiction handling both civil and criminal law actions. The Superior Court has concurrent jurisdiction with State Court over cases involving misdemeanors, contract disputes, premises liability, and various other actions. In addition, the Superior Court has exclusive equity jurisdiction over all cases of divorce, title to land, and felonies involving jury trials, including death-penalty cases. The Superior Court of Cobb County has ten elected judges who preside over jury trials, rule on evidence, hear motions, and render verdicts in bench trials. Each Superior Court Judge is elected to a four year term.

The State Court hears traffic violation and misdemeanor cases.

State Court Administration

The State Court Administration office provides administrative support for the judges of the state court as well as the Sentence Enforcement Unit. This administrative support includes budget formulation and implementation, purchasing, personnel records and management of the State Court of Cobb County’s jury system. Additionally, this office serves as liaison between the court and the other departments of county government public sector, media and other levels of government such as municipal, state and federal.

State Court Clerk

The Clerk of State Court is responsible for maintaining accurate and complete records of all court proceedings, including all traffic offenses, misdemeanors and certain civil actions. In addition, all monies of the court are received and disbursed by the clerk.

Probate Court

The Probate Court of Cobb County has exclusive jurisdiction in the following matters:

  • Probate of wills
  • Appointment and removal of executors and administrators
  • Sale and disposition of estate property
  • Appointment and removal of guardians of minors and incapacitated adults
  • Audit of returns of executors, administrators, and guardians
  • Commitments of the mentally ill, alcohol and drug abusers
  • Issuance of marriage licenses
  • Issuance of weapons carry permits
  • Miscellaneous services such as issuance of fireworks permits, recording of elected officials’ oaths and bonds
  • Certificates of residence
