NOTICE to Builders and Subcontractors

The Georgia Environmental Protection Division (EPD) reissued General NPDES Permits Nos. GAR100001, GAR100002 and GAR100003 authorizing stormwater discharges from construction activities to the waters of the State of Georgia on August 1, 2023, and as of August 23, 2024, are now in effect. These NPDES permits will authorize the discharges of stormwater to waters of the State from sites where construction activities occur through July 31, 2028.

 

Changes for all Secondary Permittees

The new GAR100003 Permit does not require an NOI for Secondary Permittees.  Therefore, you will not be able to renew Permit coverage using Georgia EPD Online System (GEOS) for electronic permit applications. To renew your Permit coverage, you must fill out an Addendum Form, sign the certification statement under “Obtaining Coverage”, and submit a copy to the Primary Permittee.  An Addendum Form can be found here https://epd.georgia.gov/construction-stormwater-instructions.  A copy should be kept for your records.

You do not have permit coverage until you sign and submit an addendum form to the Primary Permittee or you have signed the certification statement provided on their plan.  There will be a 90-day grace period to get this accomplished starting August 28, 2024.

To terminate your Permit coverage, you must first fill out an Addendum Form, sign the certification statement under “Obtaining Coverage”, sign the certification statement under “Terminating Coverage” and submit a copy to the Primary Permittee.  You cannot terminate coverage after August 22, 2024, without obtaining coverage under the 2023 permits. Primary and Tertiary Permittees

All current projects covered by the 2018 NPDES Construction Permit that were not eligible or did not terminate coverage prior to August 22, 2024 OR have or will continue to conduct land disturbance on or after August 23, 2024 must renew their NOI for continued coverage under the 2023 permit using GEOS.  There is a 90-day grace period for renewal which started August 28, 2024.  The main EPD webpage for guidance is:  https://epd.georgia.gov/construction-stormwater-instructions

Please be aware that if you do not submit a Re-Issuance Notification electronically before 11:59 pm on November 27, 2024, you will be required to submit a new NOI - Initial Notification electronically, prepare and submit a new Erosion, Sedimentation and Pollution Control Plan and pay all applicable fees for a new project.
